Chimungeni-Brassington and Comcare (Compensation)

This matter concerned an appeal by Ms Chimungeni-Brassington against a decision of the Administrative Appeals Tribunal (AAT) which affirmed a determination by Comcare. Ms Chimungeni-Brassington had lodged a claim for compensation with Comcare following a fall at work on or about 9 December 2019, subsequently notifying Comcare of a right shoulder condition. The core dispute revolved around whether Ms Chimungeni-Brassington had sustained an injury to her right shoulder as a result of the incident, and consequently, whether Comcare was liable to pay compensation.

The primary legal issue before the Tribunal was to determine whether Ms Chimungeni-Brassington had established that she sustained an injury to her right shoulder on or about 9 December 2019, or whether her employment contributed to her condition to a significant degree. This involved assessing whether the condition was a "frank injury" or a "disease" arising from her employment, and whether any pre-existing degenerative condition had been aggravated by her work.

The Tribunal found that it was not established that Ms Chimungeni-Brassington sustained an injury to her right shoulder in or about 9 December 2019. The evidence did not demonstrate that her employment contributed to her condition to a significant degree, nor was it established that her employment had made any pre-existing degenerative condition worse. Accordingly, the Tribunal concluded that Comcare had no liability to pay compensation pursuant to the claim made on 17 December 2019. The decision under review was affirmed.
