CaseChat Overview and Summary

This matter concerned an application for a Student (Temporary) (Class TU) visa, Subclass 500 (Student), where the primary dispute revolved around whether the applicant met Public Interest Criterion (PIC) 4005. The delegate had refused the visa on the basis that the applicant had not completed the requested health examinations, and therefore did not satisfy PIC 4005(1)(a)(i) and cl 500.217 of the Regulations. The Administrative Appeals Tribunal (the Tribunal) considered the evidence before it, including departmental records indicating that the applicant's health requirements had been finalised as ‘auto cleared’ on 3 March 2024.

The legal issue before the Tribunal was whether the applicant had satisfied PIC 4005, specifically concerning the requirement to undertake a specified medical assessment unless a Medical Officer of the Commonwealth decided otherwise. The Tribunal was required to determine if the applicant had met this criterion based on the available material, particularly in light of the ‘auto cleared’ status of their health requirements. The Tribunal also considered whether a hearing was necessary to resolve this issue, noting that it could make a finding in favour of the applicant based on the existing evidence pursuant to s 360(2)(a) of the Act.

The Tribunal reasoned that the departmental records showing the applicant's health requirements as ‘auto cleared’ constituted sufficient evidence that the applicant had undertaken the required medical tests and now met the requirements of PIC 4005(1) for the purposes of cl 500.217. Consequently, the Tribunal found that the applicant did meet this criterion. Given this finding, the Tribunal determined that the appropriate course of action was to remit the matter to the Minister for reconsideration of the remaining criteria for the visa. The Tribunal directed that the applicant be taken to meet PIC 4005(1) for the purposes of cl 500.217 of Schedule 2 to the Regulations.
