Chase (Migration)

The Administrative Appeals Tribunal (AAT) considered the case of Chase concerning an application for a Partner (Temporary) (Class UK) visa, subclass 820 (Spouse). The applicant sought review of a decision made by the Minister.

The primary legal issue before the Tribunal was whether the applicant met the health criteria prescribed by the Migration Regulations 1994 (Cth) for the grant of the visa. Specifically, the Tribunal had to determine if the health examinations provided by the applicant were satisfactory.

The Tribunal found that the applicant had provided a cleared health examination upon review. Consequently, the Tribunal was satisfied that the applicant met the health requirements for the visa. The Tribunal therefore remitted the decision to the Minister for reconsideration.
