CaseChat Overview and Summary

In the matter of *Chan & Lee*, heard before Rees J of the Family Court of Australia, the dispute concerned the adjustment of property interests between the applicant wife, Ms Chan, and the respondent husband, Mr Lee. The proceedings were delayed by allegations concerning the husband's interests in overseas properties. The court found that the former matrimonial home was the only significant asset to be considered.

The primary legal issues before the court were to determine the respective contributions of the parties to the acquisition, conservation, and improvement of their property, and to consider the future needs of each party in making a just and equitable adjustment of their property interests. The court also had to consider the wife's application for spousal maintenance.

Rees J found that the husband had made minimal contributions to the acquisition of the matrimonial home. Conversely, the court determined that the wife and her parents had made significantly greater contributions. Based on these findings, the court made a contributions-based adjustment of 80 per cent in favour of the wife. Further consideration of the wife’s future needs led to an additional 20 per cent adjustment in her favour. Regarding the overseas properties, the court found that while the wife was aware of the husband's interest, the husband maintained his father was the sole beneficial owner, a position unsupported by evidence. The court also found no admissible evidence of the wife's beneficial interest in a property at Suburb G, as her parents had provided the purchase money and paid outgoings. The application for spousal maintenance was dismissed due to insufficient evidence of the husband's capacity to pay.

The court ordered that the husband transfer all his right, title, and interest in the matrimonial home to the wife. The wife was ordered to indemnify the husband in respect of all liabilities relating to the property, including any mortgage, and in relation to any liability to her parents pursuant to a deed of loan. Each party was to retain other assets in their possession, and the wife's application for spousal maintenance was dismissed.
