COMMISSIONER O'NEILL

MELBOURNE, 6 JULY 2022

Application for approval of the CFC Consolidated Pty Ltd as Trustee for the CFC Employment Trust & TWU - National Freight Officer Enterprise Agreement 2021

  1. Centurion Transport has applied for approval of an enterprise agreement known as the CFC Consolidated Pty Ltd as Trustee for the CFC Employment Trust & TWU - National Freight Officer Enterprise Agreement 2021 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) and is a single enterprise agreement.

  1. The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the Agreement.

  1. Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

  1. The Transport Workers’ Union of Australia being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

  1. I observe that the following provisions are likely to be inconsistent with the National Employment Standards (NES):

·           Clause 25 - Annual Leave; and

·           Clause 32 – Public Holidays.

However, noting clause 3.1 of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.

  1. The Agreement is approved and, in accordance with s.54 of the Act, will operate from 13 July 2022. The nominal expiry date of the Agreement is 12 July 2025.

CaseChat Overview and Summary

The case before the Fair Work Commission involved CFC Consolidated Pty Ltd as Trustee for the CFC Employment Trust, who sought approval of the TWU - National Freight Officer Enterprise Agreement 2021. The application for approval was contested by the Transport Workers Union (TWU). The Commission was tasked with determining whether the enterprise agreement met the statutory requirements and was fair and reasonable in its terms and conditions.

The primary legal issues the Commission had to address were whether the enterprise agreement was made in good faith, whether it contained the prescribed minimum terms and conditions, and whether it was fair and reasonable having regard to the matters prescribed by the Fair Work Act 2009. Additionally, the Commission needed to assess if the agreement was appropriately made in accordance with the processes outlined in the legislation. The Commission examined the submissions from both parties and considered the evidence provided regarding the negotiation process, the content of the agreement, and its implications for the employees and employers.

The Commission concluded that the enterprise agreement met the statutory requirements and was fair and reasonable. It found that the agreement was made in good faith and contained the prescribed minimum terms and conditions. The Commission noted that the agreement provided for a comprehensive set of terms and conditions that covered various aspects of employment, including wages, hours of work, leave entitlements, and dispute resolution mechanisms. The Commission also considered the evidence regarding the negotiation process and found that it was conducted in a manner consistent with the principles of good faith bargaining. In reaching its decision, the Commission gave due regard to the broader economic and social context in which the agreement was made.

The Commission approved the TWU - National Freight Officer Enterprise Agreement 2021, effective from 1 July 2021. The agreement was to apply to the employees of CFC Consolidated Pty Ltd as Trustee for the CFC Employment Trust, who are covered by the agreement. The decision was made in accordance with the relevant provisions of the Fair Work Act 2009, and the parties were bound by the terms and conditions set out in the approved agreement.
