CaseChat Overview and Summary

The matter before the Fair Work Commission was an application for the approval of the Central Desert Group Enterprise Agreement 2017, which was lodged by Central Desert Native Title Services Limited. This agreement was intended to cover employees of the company who are represented by the Australian Workers' Union. The dispute centred on the provisions of the agreement and whether they complied with the relevant legislative requirements under the Fair Work Act 2009.

The central legal issue before the Commission was to determine if the agreement met the statutory prerequisites for approval, including whether it provided for the employees' wages and conditions, and whether it was made in good faith and without coercion. The Commission had to examine the fairness and reasonableness of the agreement's terms and consider whether the process followed in its creation adhered to the standards of procedural fairness. Additionally, the Commission assessed whether the agreement contained all the mandatory terms and conditions that it was required to include under the Act.

After careful consideration of the evidence and submissions, the Commission found that the agreement was fair and reasonable and met all statutory requirements for approval. The Commission was satisfied that the agreement provided for the wages and conditions of the employees and was made in good faith without any element of coercion. The process of developing the agreement was deemed to have been fair and transparent, ensuring that the employees had an opportunity to be involved in the negotiation process. Furthermore, the Commission determined that the agreement contained all the mandatory terms and conditions required by the legislation.

Accordingly, the Fair Work Commission approved the Central Desert Group Enterprise Agreement 2017. The decision was made on the basis that the agreement was fair and reasonable, was made in good faith, and complied with all the statutory requirements for approval under the Fair Work Act 2009.
