CaseChat Overview and Summary
The court was required to examine whether the enterprise agreement was genuinely negotiated and made in good faith, as required by the Fair Work Act 2009. Additionally, it needed to assess whether the process by which the agreement was made complied with the relevant provisions of the Act. Key issues included whether the agreement was made with the necessary parties and whether it was appropriately negotiated.
In its judgment, the court found that the agreement was not genuinely negotiated and made in good faith. The process lacked the necessary engagement with the relevant parties, and the agreement did not reflect a fair and genuine negotiation process. The court held that the agreement was invalid due to these deficiencies. As a result, the Catholic Church Endowment Society Inc's claims were upheld, and the agreement was declared void.
Consequently, the court issued orders to declare the South Australian Catholic Schools Enterprise Agreement 2013 invalid, reflecting the findings that it was not genuinely negotiated and made in good faith. The agreement was also found to be non-compliant with the statutory requirements of the Fair Work Act 2009.
