CaseChat Overview and Summary

In *Casson and Jerry*, heard before Judge Brown, the applicant, Mr Casson, and the respondent, Mr Jerry, sought a final resolution of their property claims arising from a de facto relationship. The core of the dispute concerned the division of assets acquired during the relationship, including real estate, vehicles, and financial resources.

The court was required to determine whether a de facto relationship existed between the parties and, if so, to make orders for the settlement of their property interests. Specifically, the court needed to assess the contributions of each party, both financial and non-financial, to the acquisition, conservation, and improvement of the property pool, and to consider the future needs of each party in making its determination.

Judge Brown declared that a de facto relationship existed between Mr Casson and Mr Jerry from 2005 to 2016, pursuant to section 90RD(1) of the *Family Law Act 1975*. In making orders for the full and final settlement of property claims, the court ordered Mr Casson to pay Mr Jerry $125,000 within 42 days. Contemporaneously, Mr Jerry was to transfer his interest in the parties' former home to Mr Casson, with Mr Casson to discharge the mortgage and indemnify Mr Jerry against all liabilities associated with that property. Mr Casson was to retain his interests in Property A (Queensland) and Property B (South Australia), and indemnify Mr Jerry against all associated mortgage payments and outgoings. Both parties were to retain their respective personal property, vehicles, savings, investments, and superannuation entitlements, free from any further claim by the other. All other applications were dismissed.
