The respondents submitted that there were factual conflicts in the affidavit evidence and that the applicants had obtained a previous order against two of the respondents by consent, which created a res judicata. The Court held that it was not satisfied that the respondents had no reasonable prospect of successfully defending the proceeding because of the factual conflicts in the affidavit evidence. The Court also held that the previous order by consent did not create a res judicata because it did not determine the merits of the applicants’ claims against the other respondents.

The Court dismissed the applicants’ interlocutory application for summary judgment against the respondents. The Court ordered that there be no order as to costs.
