Careers Zodiac Pty Ltd (Migration)

The Administrative Appeals Tribunal considered an application by Careers Zodiac Pty Ltd for approval as a temporary activities sponsor. The dispute arose because the Department of Home Affairs had refused the application based on adverse information concerning Mr. Shivam Joshi, a person associated with the applicant. The applicant argued that this adverse information should be disregarded.

The Tribunal was required to determine whether the applicant met the criteria for approval as a temporary activities sponsor under regulations 2.60 and 2.60S of the Migration Regulations 1994. Specifically, the Tribunal had to assess if the applicant had followed the correct application process, was lawfully operating in Australia, and crucially, whether it was reasonable to disregard the adverse information relating to Mr. Joshi's previous business interests, namely the cancellation of his former company's sponsorship.

The Tribunal reasoned that the applicant had met the procedural requirements for application and was lawfully operating a business in Australia. Regarding the adverse information, the Tribunal noted that Mr. Joshi's former company's sponsorship was cancelled administratively after the company was dissolved and no notification was given to the Department. While this constituted adverse information, the Tribunal found that Mr. Joshi's decision to wind up the company was due to personal circumstances and business viability issues, not insolvency. Considering the passage of time, the applicant's strong business plan, and the circumstances surrounding the dissolution of the previous company, the Tribunal concluded that it was reasonable to disregard the adverse information.

Consequently, the Tribunal set aside the Department's decision not to approve the application and substituted a decision approving Careers Zodiac Pty Ltd as a temporary activities sponsor.
