Cappetto and Cappetto

In the matter of *Cappetto and Cappetto*, Watts J considered a dispute between the parents concerning the living arrangements and contact arrangements for their two children, B and S. The proceedings involved an application by the mother filed on 4 May 2010, which was ultimately dismissed.

The court was required to determine the primary residence of the children, the nature and extent of contact between the children and their father, and the conditions under which such contact would occur. Additionally, the court addressed the need for a Chapter 15 report, the role of the Independent Children's Lawyer, and the management of the children's passports.

Watts J reasoned that the previous orders made on 22 September 2009 should be discharged. The court ordered that the children live with the mother and spend supervised time with the father each Saturday for two hours, initially at a shopping centre and subsequently at the Sydney Children’s Contact Centre once arrangements were finalised. The father agreed to withdraw applications alleging contravention of existing orders. The court also made detailed provisions regarding the parties' obligations to facilitate supervised contact, including compliance with the contact centre's requirements and the mother's responsibility for delivering and collecting the children. The court further ordered the mother to deliver the children's passports to the Registrar and granted the Independent Children's Lawyer leave to issue subpoenas.
