Cantarella Bros Pty Ltd v Valcorp Fine Foods Pty Ltd

Cantarella Bros Pty Ltd sought injunctive relief and an order for corrective advertising against Valcorp Fine Foods Pty Ltd. The dispute was before Lindgren J in the Federal Court of Australia. Cantarella argued that Valcorp's advertisements were misleading or deceptive, contrary to the Australian Consumer Law, and sought declarations of infringement if the primary relief was denied on discretionary grounds. The court concluded that the advertisement in Annexure A was misleading or deceptive, while the advertisements in Annexures B and C were not. The court found that the advertisement in Annexure A could mislead readers into believing that Valcorp's coffee was the number one coffee in Australia since 1996, which was not accurate. The court found that the advertisements in Annexures B and C did not make any misleading claims and were therefore not misleading or deceptive.

Accordingly, Cantarella succeeded in relation to the advertisements in Annexures A and B but not in relation to the advertisement in Annexure C. The court decided to stand over the application to allow the parties to agree on the form of relief and costs. The parties were instructed to provide an agreed form of the orders to be made, or if they could not agree, to provide the forms of orders for which they would contend.
