Their Honours reasoned that while covenants can bind future owners and apply to future works, the specific wording of this covenant did not extend to the construction of an entirely new system. The phrase "any drainage works" was interpreted in light of the context and the ordinary meaning of the words, which did not readily include the creation of a new, previously non-existent, drainage infrastructure. The court considered that if the parties had intended to cover such future works, clearer language would have been used.

The appeal was dismissed, and the orders of the Supreme Court of New South Wales were affirmed.
