CaseChat Overview and Summary

Calendar Cheese Company Pty Ltd applied to the Fair Work Commission for approval of the Calendar Cheese Company Enterprise Agreement 2015. The dispute arose from the company's desire to implement changes to employee conditions, which led to negotiations that resulted in the proposed agreement. The application was subject to scrutiny as it involved changes that could potentially affect the employees' rights and conditions.

The central legal issues before the Fair Work Commission were whether the agreement complied with the relevant provisions of the Fair Work Act 2009 and whether it met the requirements for "better off overall" and "in the interests of employees." The Commission had to determine if the proposed changes provided genuine benefits to the employees and if they were fair and reasonable.

In its decision, the Fair Work Commission considered the evidence presented by both parties and examined the provisions of the Fair Work Act. The Commission found that the proposed agreement provided for conditions that were no worse than the applicable award or safety net awards and that the changes were fair and reasonable. The Commission was satisfied that the agreement would be better off overall for the employees, as it included provisions for increased wages and improved working conditions. Therefore, the Commission approved the enterprise agreement.

The Fair Work Commission's final orders were that the Calendar Cheese Company Enterprise Agreement 2015 be approved in accordance with section 231 of the Fair Work Act 2009. The approved agreement was to be registered with the Commission and would take effect from the date of registration.
