CaseChat Overview and Summary
In the matter of PAC 6215 of 2018, Ms Cabra (the applicant) and Mr Tackett (the respondent) sought orders concerning their child, X, born in 2013. The proceedings were before Judge Obradovic.
The court was required to determine the arrangements for parental responsibility, the child's living arrangements, and the time the child would spend with each parent, including during school terms, school holidays, and on special occasions. The court also needed to address communication between the parents and the child, and the location for changeovers.
By consent and on a final basis, the court ordered that the parents have equal shared parental responsibility for X, with communication to occur via email and/or text. X was ordered to live with the mother. The father was granted specific time with X during school terms on a two-week cycle, during school holidays, and on certain special occasions, with provisions for agreement or default arrangements. The mother was also granted specific time with X on X's birthday, the mother's birthday, and Mother's Day, notwithstanding other orders. Changeovers were to occur at a specified school gate unless otherwise agreed. The court also made orders facilitating telephone communication between X and each parent, instigated by X.
