CaseChat Overview and Summary
The key legal issues before the Commission were whether the agreement met the criteria for registration under section 234 of the Act. This involved assessing whether the agreement contained the required provisions, was made in good faith, and whether the bargaining was genuinely done. The Commission also had to consider if the agreement was in the best interests of the employees and the broader public.
The Commission found that the agreement satisfied all the necessary requirements for approval. It contained the mandatory provisions as stipulated in the Act, including those relating to minimum wages, penalty rates, and leave entitlements. The Commission was satisfied that the agreement had been made in good faith and that the bargaining process was genuine. Additionally, the Commission considered that the agreement was in the best interests of the employees, providing them with fair and reasonable terms and conditions of employment. Accordingly, the Commission approved the agreement.
The final orders of the Commission were that the Burke Industries Pty Ltd Enterprise Agreement 2016-2020 be registered under the Fair Work Act 2009. The agreement was to be treated as if it had been made directly by the parties on the date it was registered.
