Bur16 v Minister for Immigration

The applicant, Bur16, sought judicial review of a decision made by the Administrative Appeals Tribunal concerning an application for a Protection (Class XA) Visa. The Minister for Immigration was the respondent.

The primary legal issue before the court was whether the Administrative Appeals Tribunal had committed a jurisdictional error in its consideration of the applicant's claims and its subsequent decision. Justice Kirton QC found no jurisdictional error on the part of the Administrative Appeals Tribunal. The court noted that the applicant had failed to file written submissions and had made no oral submissions during the judicial review hearing. In light of this, and having considered the applicant’s claims and the Tribunal’s decision, the application for judicial review was dismissed.
