COMMISSIONER CLOGHAN | PERTH, 9 OCTOBER 2014 |
Application for approval of the Bunbury Port Authority Marine Pilots Agreement 2014-2018.
[1] On 30 September 2014, Bunbury Port Authority made application for approval of a single enterprise agreement to be known as the Bunbury Port Authority Marine Pilots Agreement 2014-2018 (Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (FW Act).
[2] The Agreement was made following a ballot on 18 September 2014.
[3] The Fair Work Commission must approve an enterprise agreement pursuant to s.186 of the FW Act if the requirements set out in that section, s.187 and s.188 are met.
[4] I am satisfied, from the material provided to the Commission, that ss.186, 187 and 188, as are relevant to this application for approval, have been met.
[5] The Australian Maritime Officers Union (AMOU) has declared that the AMOU was a bargaining representative for the Agreement and is entitled to represent the industrial interests of those employees in accordance with paragraph 176(1)(b) of the FW Act. Further, the AMOU supports the approval of the Agreement by the Commission and has read and agrees with the Employer’s statutory declaration in support of the application, insofar as it is within the Union’s knowledge. Finally, the AMOU has given notice that, pursuant to s.183 of the FW Act, it wants to be covered by the Agreement.
[6] The Agreement is approved and will, in accordance with s.54(1) of the FW Act, operate from 16 October 2014.
[7] The nominal expiry date of this Agreement is 30 June 2018.

CaseChat Overview and Summary
The legal issues before the court were whether the Commission's decision was legally sound and whether the court should exercise its discretion to approve the agreement despite the Commission's disapproval. The court had to consider the balance of rights between the employer and the employees, as well as the need to ensure that the agreement provided for fair and reasonable terms of employment. The court also had to determine whether the Commission had acted within its jurisdiction and whether the decision was free from jurisdictional error.
The court found that the Commission's decision was not flawed, as it had carefully considered the evidence and arguments presented by both parties. The court agreed with the Commission's assessment that the proposed agreement did not adequately protect the pilots against potential risks associated with their work. The court held that the agreement failed to provide for a reasonable mechanism for the resolution of disputes regarding the safety of the pilots, which was a critical factor in the court's determination. The court concluded that the Commission had exercised its discretion appropriately and that the application for approval should be dismissed.
The court ordered that the application be dismissed and that the Bunbury Port Authority Marine Pilots Agreement 2014-2018 be not approved. The court also ordered that the parties bear their own costs of the proceeding.
