CaseChat Overview and Summary
The Commission reviewed the application and the supporting material to ascertain whether the requirements of the Fair Work Act had been met. The key issues were whether the agreement was a bona fide enterprise agreement, whether it had been made in good faith, and whether it included the necessary provisions as required by the Act. Furthermore, the Commission had to determine if the agreement was to be approved as covering the Independent Education Union of Australia.
After careful consideration of the evidence and the relevant sections of the Act, the Commission found that the agreement met all the necessary criteria for approval. The agreement was bona fide, made in good faith, and included all the required provisions. The Commission also confirmed that the agreement would cover the Independent Education Union of Australia, as it had given notice under section 183 of the Act. Consequently, the Commission approved the agreement, which would come into effect on 17 March 2015, with a nominal expiry date of 31 December 2017.
