The court held that the appellant failed to demonstrate that the learned primary judge's findings were clearly wrong. The court further held that the learned primary judge did not err in his assessment of the evidence regarding the gratuitous services under s 59(1) of the Civil Liability Act 2003 (Qld).

The appeal was dismissed, and the appellant was ordered to pay the respondents’ costs of the appeal on the standard basis.
