Brodie & Whang

In the matter of *Brodie & Whang*, heard by Baumann J, the applicant, Mr Brodie, had filed a Notice of Discontinuance in relation to his Application. Neither party attended a subsequent Case Management Hearing.

The central issue before the Court was whether to dismiss all applications before it, given the applicant's discontinuance and the parties' non-attendance at the hearing. The Court was also required to determine the appropriate orders regarding the costs of the application.

Baumann J noted the applicant's prior exchanges with the Bench on 26 March 2021 and the subsequent filing of the Notice of Discontinuance on 19 April 2021. In light of these circumstances, the Court ordered that all applications before it be dismissed. Furthermore, the Court made no order as to the costs of the application.
