Application for approval of the Broadspectrum and United Firefighters' Union of Australia (QLD Branch) Enterprise Agreement 2018.
An application has been made for approval of an enterprise agreement known as the Broadspectrum and United Firefighters’ Union of Australia (QLD Branch) Enterprise Agreement 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Broadspectrum (Australia) Pty Ltd T/A Broadspectrum. The Agreement is a single enterprise agreement.
The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.
Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
I note that Clause 22 is inconsistent with the National Employment Standards. Given the National Employment Standards precedence clause at clause 7 of the agreement, I am satisfied that the more beneficial entitlements of the NES will prevail.
The Agreement lodged contained an error at Clause 28. On 8 March 2019, the Applicant filed an amended version of the Agreement correcting this error. I am satisfied that the correction should be made and that it is appropriate to do so pursuant to s.586 of the Act.
The United Firefighters’ Union of Australia being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 29 March 2019. The nominal expiry date of the Agreement is 22 September 2022.

CaseChat Overview and Summary
The legal issues before the Fair Work Commission included whether the Enterprise Agreement contained provisions that unfairly disadvantaged employees, whether it provided adequate mechanisms for dispute resolution, and whether it complied with the Good Faith Bargaining provisions. Additionally, the Commission needed to consider if the agreement met the statutory requirements for pay equity, minimum working conditions, and any other relevant industrial standards. The application for approval necessitated a comprehensive review of the agreement to ensure it was just and equitable for both parties and adhered to the legislative framework governing industrial relations in Australia.
In reaching its decision, the Fair Work Commission meticulously examined each clause of the Enterprise Agreement, considering the provisions' alignment with the Fair Work Act and other relevant industrial laws. The Commission determined that the agreement, while generally fair, required some amendments to ensure compliance with the statutory requirements. The Commission made several orders to rectify these issues, including modifications to specific clauses to ensure fairness and compliance with the legislative framework. Ultimately, the Fair Work Commission approved the Enterprise Agreement 2018, subject to the modifications ordered, ensuring that it met the necessary legal standards and provided a fair and equitable arrangement for both Broadspectrum and the United Firefighters' Union of Australia (QLD Branch).
