CaseChat Overview and Summary
The legal issues before the FWC were primarily whether the proposed enterprise agreement met the criteria for approval under the Fair Work Act 2009. This included determining whether the agreement provided for fair remuneration and conditions, whether it ensured a safety net of minimum entitlements, and whether it adhered to the procedural requirements for enterprise agreements. The FWC also had to consider whether the agreement provided for genuine bargaining and whether it met the "better off overall test" (BOOT) for employees.
In its decision, the FWC examined the evidence and submissions from both parties, focusing on the procedural fairness of the bargaining process and the substantive provisions of the agreement. The FWC found that the agreement had been negotiated in good faith and that the bargaining process was genuine. Regarding the substantive provisions, while the FWC acknowledged some concerns raised by the AMWU, it concluded that the agreement provided for fair and reasonable terms and conditions of employment. Importantly, the FWC determined that the agreement met the BOOT, as it provided employees with better overall terms and conditions compared to the applicable awards. Consequently, the FWC approved the Bridgestone Australia Ltd. WA Warehouse Enterprise Agreement 2023, recognising it as a lawful and fair agreement under the Fair Work Act.
