Brewarrina Shire Council (the Council) appealed from summary judgment orders made in favour of Beckhaus Civil Pty Ltd (Beckhaus). This was based on two alternative grounds: either as a non-promissory condition precedent or as an obligation imposed on the contractor that conditioned the Superintendent's duty. The Court drew an analogy to the purchaser's obligation to serve a notice to complete in a conveyancing context. The Court found that the contractor had not adequately discharged this condition precedent.
Consequently, the Court upheld the appeal, set aside the summary judgment orders granted to Beckhaus, and granted leave to Beckhaus to defend the proceedings. The Court ordered that Beckhaus pay the costs of the application for summary judgment and the costs of the appeal.
