Section 365 – jurisdictional objection dismissed – matter resolved

For reasons given on transcript earlier today, I concluded that the applicant in this matter was dismissed by the respondent and was therefore eligible to make his application under s 365 of the Fair Work Act 2009 (Act). I then proceeded to conduct a conference and the dispute was successfully resolved.
