CaseChat Overview and Summary

In *Bracken and Kinder*, heard by Barry J, the dispute concerned parenting orders for a child, D, born in March 2005. The court was required to determine the living arrangements for the child, the allocation of parental responsibility for long-term and day-to-day decisions, and the terms upon which the Mother would spend time with the child.

Barry J ordered that the child, D, live with the Father and that the Father have sole parental responsibility for all long-term and day-to-day decisions concerning D's care, welfare, and development. The Mother was granted time with the child under specific conditions. These conditions included spending time with D at mutually agreed times and places, or, in the absence of agreement, from Friday 4:00 pm to Sunday 4:00 pm on weekends when the Mother is in Brisbane, provided she gives ten days' written notice and such time is supervised by a person approved by the Father. If the Father unreasonably refused to approve a supervisor, a judge of the court could approve one. The Mother was also to have half of school holidays, subject to similar supervision requirements, and to have telephone contact every Monday and Wednesday between 5:30 pm and 6:30 pm. The Father was ordered to provide the Mother with details of D's medical treatment. The Independent Children's Lawyer was discharged, and liberty to apply was granted on fourteen days' notice. The orders also included a document detailing obligations, consequences of contravention, and assistance available to the parties.
