This matter concerned an application for a Subclass 602 Medical Treatment visa, where the applicant sought to remain in Australia temporarily for medical treatment. The primary dispute before the Tribunal was whether the applicant was medically unfit to depart Australia, and if not, whether he genuinely intended to remain in Australia temporarily for the purpose of the visa. In reaching its decision, the Tribunal found that the applicant did not meet the criteria for being medically unfit to depart Australia, noting he was 44 years old and there was no evidence of a permanent or deteriorating disease or condition that would render him unfit to travel. Consequently, the applicant was required to satisfy the genuine temporary entrant requirement. The Tribunal expressed significant concerns regarding the applicant's claimed mental health issues, depression, and anxiety. Despite claiming a need for weekly therapy, the applicant provided no evidence of the type of assessment or treatment received, nor the number of consultations. He also stated he had not followed up on recommended treatment and had not seen a mental health professional for six months, which cast doubt on the genuineness of his claim and his intention to comply with visa conditions.

Accordingly, the Tribunal affirmed the decision not to grant the applicant a Subclass 602 Medical Treatment visa, as he failed to meet the necessary requirements for its grant.
