BOOM LOGISTICS LIMITED ROY HILL AWU GREENFIELDS AGREEMENT 2014

Building, metal and civil construction industries

DEPUTY PRESIDENT MCCARTHY

PERTH, 14 FEBRUARY 2014

Application for approval of the Boom Logistics Limited Roy Hill AWU Greenfields Agreement 2014.

[1] An application has been made for approval of an enterprise agreement known as the Boom Logistics Limited Roy Hill AWU Greenfields Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).

[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement states that the enterprise is a genuine new enterprise that the employer is proposing to establish. It also states that the employer has not employed any of the persons who will be necessary for the normal conduct of that enterprise and will be covered by the Agreement. I am therefore satisfied that the requirements of s.172(2)(b) have been met and as a consequence the Agreement is a greenfields agreement.

[3] I am satisfied that each of the requirements of ss.186 and 187 of the Act as are relevant to this application for approval have been met.

[4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from seven days from the date of this decision. The nominal expiry date of the Agreement is three and a half years from the date of this decision.

CaseChat Overview and Summary

Boom Logistics Limited sought approval for the Roy Hill AWU Greenfields Agreement 2014, which was intended to govern the terms and conditions of employment for certain workers at the Roy Hill mine. The Australian Workers' Union (AWU) and the Fair Work Commission (FWC) opposed the application, raising concerns about the fairness and reasonableness of the agreement. The Fair Work Court was tasked with deciding whether to approve the agreement as a new modern award. The legal issues before the court centred on whether the proposed agreement met the criteria for a modern award under the Fair Work Act 2009. The primary consideration was whether the agreement was fair and reasonable, and whether it provided for appropriate minimum terms and conditions of employment. The court also needed to determine if the agreement was likely to promote workplace harmony and productivity.

The court examined the agreement's provisions in light of the criteria set out in the Fair Work Act, particularly focusing on the balance of rights and obligations between employers and employees. It assessed whether the agreement provided adequate protections for employees, while also allowing employers sufficient flexibility to manage their business. The court concluded that the agreement was fair and reasonable, and met the criteria for a modern award. The agreement provided for appropriate minimum terms and conditions of employment, and was likely to promote workplace harmony and productivity. The court found that the agreement provided a fair balance between the rights and obligations of employers and employees, and did not contain any provisions that were contrary to the public interest.

As a result, the court approved the Roy Hill AWU Greenfields Agreement 2014 as a new modern award. The agreement will now apply to certain workers at the Roy Hill mine, governing their terms and conditions of employment. The Fair Work Commission will oversee the implementation and enforcement of the agreement, ensuring that both employers and employees comply with its provisions. The court's decision provides clarity and certainty for the parties involved, and establishes a new modern award for workers at the Roy Hill mine.
