Body Corporate of Balmattum v Biddle

The case of Body Corporate of Balmattum v Biddle involved the plaintiff, a body corporate responsible for managing a rural residential community title scheme, and the defendants, one of the resident owners within the scheme. The dispute arose from the defendants’ failure to pay their body corporate levies for approximately 13 years. The plaintiff sought payment of the outstanding levies, interest, and costs associated with recovering the levies. The defendants, in turn, sought enforcement of costs orders made against the plaintiff in earlier proceedings in the District Court. The court found that the plaintiff's resistance to paying the costs orders until the outstanding sums were settled was reasonable. As a result, the defendants were ordered to pay the plaintiff's costs associated with the applications filed on 4 December 2015 and 23 February 2016, to be assessed on the standard basis.
