CaseChat Overview and Summary

In the case of Black Cedar Investments Pty Ltd v Valuer General NSW, the dispute involved the determination of the land value for a property located at 88-90 Mulgoa Road, Jamisontown, for the valuing year commencing 1 July 2019. The matter was heard and determined by the Supreme Court of New South Wales. The plaintiff, Black Cedar Investments Pty Ltd, sought to challenge the land value assessment set by the defendant, the Valuer General of New South Wales.

The primary legal issues the Court needed to address were whether the Valuer General correctly assessed the land value according to the provisions of the Valuation of Land Act 1916 and whether the methodology used in the assessment was appropriate and aligned with statutory requirements. Specifically, the Court had to examine whether the Valuer General had correctly applied the market value approach and whether the valuation reflected the true market value of the land as of the relevant date.

In its judgment, the Court found that the Valuer General had not correctly applied the statutory provisions and had made errors in the valuation process. The Court held that the assessment did not accurately reflect the market value of the land as required by law. The Court determined that the correct land value for the specified property and period should be $7,490,000, as per section 6A of the Act. The Court ordered that the Valuer General must adjust the Register of Land Values to reflect this new valuation. Both parties were to bear their own costs for the proceedings.
