Bing and Bing

In the matter of Bing and Bing, Justice Cronin considered an application concerning property settlement and financial orders. The dispute involved the husband and wife, with specific applications filed by each party on 10 and 16 June 2009 respectively.

The court was required to determine several issues, including the adjournment of specific paragraphs of the parties' applications, the variation of existing orders to permit further encumbrance of a property by J Pty Ltd as trustee of the J Trust and the husband, and the wife's obligation to execute documents to facilitate a bank advance. The court also had to consider the dismissal of other paragraphs of the filed applications.

Justice Cronin ordered that certain paragraphs of the husband's and wife's applications be adjourned to a later date. Crucially, the court varied previous orders to allow J Pty Ltd and the husband to further encumber the property at F. This variation was to facilitate a National Australia Bank advance of $1,869,000 to J Pty Ltd, for which the wife was ordered to execute all necessary documents. The remaining paragraphs of the parties' applications were dismissed.
