The Tribunal found Mr Bhogal's explanation for the timing of these events to be reasonable, particularly noting that the complexities of business ownership and registration changes were not matters a cook would necessarily be privy to.

Consequently, the Tribunal remitted the decision to the delegate for reconsideration, indicating that the refusal based on PIC 4020 was not upheld on the basis of the provided explanation.
