In the matter of *Beyersdorf & Chu*, heard before Aldridge J, the applicant's affidavits were found to be not in the proper form. This deficiency meant that the proceedings could not proceed to a hearing as scheduled.

The central legal issue before the court was whether, in light of the applicant's non-compliant affidavits, it was appropriate to adjourn the proceedings and, if so, who should bear the costs of the day.

Aldridge J determined that the adjournment was necessitated by the applicant's failure to file affidavits in the proper form. Consequently, the court ordered that the applicant pay the respondent's costs of the proceedings for that day, to be agreed upon or assessed. The matter was then adjourned to the duty list on 14 July 2014 at 9:30 am.
