CaseChat Overview and Summary

Bell Wiggins Pty Ltd was a party to an enterprise agreement which was due for renewal in 2019. The Australian Council of Trade Unions (ACTU) filed an application for the approval of the proposed agreement under section 231 of the Fair Work Act 2009. The application was heard by the Fair Work Commission (FWC) with Deputy President Campbell and Commissioner Finn. The employer objected to the proposed agreement on various grounds, including concerns about its financial impact, the adequacy of dispute resolution provisions, and the appropriateness of certain terms.

The legal issues before the FWC included whether the proposed agreement complied with the formal and substantive requirements set out in the Fair Work Act, particularly in relation to the financial impact on the employer, the dispute resolution mechanisms, and the appropriateness of certain terms. The employer argued that the agreement would place an undue financial burden on the company, that the dispute resolution provisions were inadequate, and that some of the terms were not reasonably necessary for the protection of employees' rights or interests.

The FWC found that the proposed agreement was compliant with the requirements of the Fair Work Act. The Commission concluded that the employer had not demonstrated that the agreement would place an undue financial burden on the company. The dispute resolution provisions were deemed to be adequate, and the terms that the employer challenged were found to be reasonably necessary for the protection of employees' rights or interests. The FWC approved the proposed agreement under section 232 of the Fair Work Act.

The FWC approved the Bell Wiggins Pty Ltd Enterprise Agreement 2015-2019, effective from 1 April 2019, until 31 March 2024. The employer was ordered to give written notice of the approval to the employees covered by the agreement within 28 days of the decision. The agreement was to be registered with the Fair Work Commission within 14 days of the decision.
