CaseChat Overview and Summary
In the matter of Beasley and Yates, Foster J considered the financial and property settlement between a husband and wife. The dispute concerned the division of assets, including shareholdings in a company and real property, and the allocation of liabilities associated with these assets.
The court was required to determine the appropriate orders for the transfer of property and the payment of sums between the parties, as well as the indemnification of liabilities. Specifically, the court had to decide the terms upon which the wife would acquire the husband's interests in B Pty Ltd and a property located at C Street, Suburb D, and how existing financial liabilities, including a Westpac Commercial Bill Facility and a joint mortgage, would be managed and discharged.
Foster J ordered that the wife pay the husband $100,000 within 14 days, upon which the husband was to transfer his shareholding and directorship in B Pty Ltd to the wife and be indemnified by her from all liabilities arising from the company's affairs and the joint Westpac Commercial Bill Facility. Further, the wife was to pay the husband $634,677 within four months, in consideration of which the husband would transfer his interest in the C Street property. Concurrently, the wife was to procure the discharge of the joint mortgage over that property, releasing the husband from liability. Pending the property transfer, the wife was granted sole use and occupation of the C Street property and was to indemnify the husband from all liabilities and outgoings related to the joint mortgage from the date of the order. The wife was also to receive all dividend entitlements from B Pty Ltd from that date.
