Baine and Baine

In the matter of *Baine and Baine*, heard before Strickland J, the husband failed to appear at a scheduled hearing concerning an Application in a Case filed by the wife. The wife's application, filed on 21 March 2013, was before the court for further consideration.

The primary legal issue before the court was the husband's unexplained absence from the hearing. Consequently, the court was required to determine the appropriate course of action to address this non-appearance and to ensure the progression of the wife's application.

Strickland J ordered that the husband must, within fourteen days, file and serve an affidavit explaining his failure to attend the hearing. Furthermore, the husband was directed to file and serve a Financial Statement within twenty-one days. The wife's Application in a Case was adjourned for further consideration to 9:15 am on Monday, 13 May 2013, before the Honourable Justice Dawe.
