CaseChat Overview and Summary

The Administrative Appeals Tribunal (AAT) considered an application for a Subclass 500 (Student) visa. The applicant sought to review a decision to refuse this visa. The central issue was whether the applicant met the criteria of being a "genuine temporary entrant" as required by clause 500.212 of Schedule 2 to the Migration Regulations 1994.

The Tribunal was required to determine if the applicant genuinely intended to stay in Australia temporarily, having regard to their circumstances, immigration history, and any other relevant matters, in accordance with Direction No. 69 issued under section 499 of the Migration Act 1958. This Direction outlines factors to consider, including the applicant's circumstances in their home country and potential circumstances in Australia, the value of the proposed course to the applicant's future, and their immigration history.

The Tribunal found that the applicant's immigration history, which indicated a continuous presence in Australia on various temporary visas for approximately 21 years, was inconsistent with the notion of a genuine temporary entrant. While acknowledging the applicant had completed several courses, the Tribunal was not satisfied that the proposed course offered a demonstrable benefit to the applicant's future that would outweigh the significant financial commitment and extended period of stay. The Tribunal concluded that the applicant's prolonged presence and study history suggested an intention to use the student program to maintain ongoing residence in Australia rather than to temporarily enter for study.

Consequently, the Tribunal was not satisfied that the applicant met the genuine temporary entrant criterion under clause 500.212(a) of the Regulations. Accordingly, the Tribunal affirmed the decision not to grant the applicant a Subclass 500 (Student) visa.
