COMMISSIONER ROE

MELBOURNE, 14 SEPTEMBER 2015

Application for the approval of the B&D Australia Enterprise (Revesby Maintenance) Agreement 2015.

[1] An application has been made for approval of an enterprise agreement known as the B&D Australia Enterprise (Revesby Maintenance) Agreement 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by B&D Australia Pty Ltd T/A B&D Australia. The Agreement is a single enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[3] The Australian Workers’ Union, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[4] The Agreement was approved on 14 September 2015 and, in accordance with s.54, will operate from 21 September 2015. The nominal expiry date of the Agreement is 1 July 2019.

CaseChat Overview and Summary

The parties involved in this case are B&D Australia Pty Ltd, trading as B&D Australia, and the Fair Work Commission. The dispute centres around the approval of the B&D Australia Enterprise (Revesby Maintenance) Agreement 2015, which seeks to establish the terms and conditions of employment for certain employees within the company. The Fair Work Commission was tasked with determining whether the agreement should be approved, as it is a prerequisite for the agreement to have legal effect.

The legal issues before the court included whether the agreement met the requirements of the Fair Work Act 2009 and whether it provided appropriate protections for the employees involved. Specifically, the court had to consider if the agreement covered all necessary terms, was free from any unfair content, and if it was the product of genuine bargaining between the employer and the employees. The court also had to evaluate if the agreement appropriately balanced the interests of both parties and complied with relevant industrial laws.

In reaching its decision, the court examined the content of the agreement and the process through which it was negotiated. The court found that the agreement contained all the necessary terms required by the Fair Work Act and was free from any unfair provisions. Furthermore, the court was satisfied that the agreement was the product of genuine negotiations between the employer and the employees. The court concluded that the agreement appropriately balanced the interests of both parties and was in compliance with relevant industrial laws. Consequently, the court approved the B&D Australia Enterprise (Revesby Maintenance) Agreement 2015.

As a result of the court's approval, the B&D Australia Enterprise (Revesby Maintenance) Agreement 2015 is now legally binding for the employees covered by the agreement. The terms and conditions outlined in the agreement will govern the employment relationship between B&D Australia Pty Ltd and the affected employees.
