CaseChat Overview and Summary
The legal issues that the Commission was required to decide included whether the agreement provided for the minimum entitlements as mandated by the Fair Work Act, and whether the agreement was made in good faith and without coercion. Another significant issue was the extent to which the agreement complied with the Fair Work (Registered Organisations) Act 2009, specifically the requirement for the agreement to specify the rate of pay and conditions of employment.
The Fair Work Commission, after considering the evidence and submissions from both parties, found that the AWMA Enterprise Agreement 2021 was fair and reasonable. The Commission held that the agreement met all the statutory requirements, including those relating to minimum entitlements and good faith bargaining. The Commission also determined that the agreement complied with the requirements of the Fair Work (Registered Organisations) Act. Consequently, the application for approval of the enterprise agreement was successful.
The Fair Work Commission approved the AWMA Enterprise Agreement 2021, effective from 1 July 2021. The agreement is to be registered with the Fair Work Commission, and will govern the employment conditions of the employees covered by the agreement until it is terminated or replaced by a new agreement.
