CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement was genuinely an enterprise agreement, if the union had sufficient representation to seek the agreement, and whether the agreement contained any provisions that would have an adverse effect on the safety of employees or the public. The Commission also needed to consider whether the agreement contained any provisions that would result in a person being paid less than the applicable award or registered agreement. The Commission had to examine the agreement's provisions and determine whether they met the requirements of the Fair Work Act.
The Fair Work Commission found that the agreement was genuinely an enterprise agreement and that the union had sufficient representation to seek the agreement. The Commission also found that the agreement did not contain any provisions that would have an adverse effect on the safety of employees or the public, nor did it result in any person being paid less than the applicable award or registered agreement. The Commission approved the agreement, finding that it met the requirements for approval under section 231 of the Fair Work Act.
The Commission approved the Mechanical Maintenance Solutions Pty Ltd (MMS) AMWU Agreement for Yallourn Power Station and Opencut Mine Victoria, Greenfields Enterprise Agreement 2013, effective from 1 July 2013.
