CaseChat Overview and Summary

This matter concerned an application by Autchariya Thai Massage Pty Ltd for approval of an employer nomination for the position of Massage Therapist under the Temporary Residence Transition stream. The applicant sought to sponsor Mr Sasipong Wangpaibul, who held a Subclass 457 visa and had commenced employment with the applicant as a Massage Therapist. The core dispute revolved around whether the applicant met the general and stream-specific requirements for the nomination to be approved, particularly in light of potential adverse information and whether the nominated position accurately reflected the duties performed by the nominee.

The legal issues before the Tribunal were whether the applicant had complied with the procedural requirements for lodging the nomination application under regulation 5.19(2) and whether the nomination met the general requirements stipulated in regulation 5.19(4). Specifically, the Tribunal had to determine if there was any adverse information known to the Department about the nominator or associated persons, and if so, whether it was reasonable to disregard such information, as required by regulation 5.19(4)(b). The Tribunal also considered the definition of "adverse information" and "associated with" as provided in regulations 1.13A and 1.13B.

The Tribunal reasoned that the applicant had satisfied the procedural requirements of regulation 5.19(2) and the general requirements of regulation 5.19(4)(a). Crucially, the Tribunal found that while there may have been information suggesting the nominee performed tasks outside the strict definition of a Massage Therapist, it was reasonable to disregard this information. This was based on the steps taken by the applicant to rectify any perceived breaches and the fact that the Department had subsequently approved the nominee's sponsorship. The Tribunal concluded that all requirements for the nomination to be approved had been met.

Consequently, the Tribunal set aside the decision under review and substituted a decision approving the employer nomination.
