CaseChat Overview and Summary

The Fair Work Commission considered an application for approval of the Freighter Group Enterprise Agreement - Hallam 2025, made by Australian Trailer Solutions Group Services Pty Ltd (trading as Freighter Group) under section 185 of the Fair Work Act 2009. The agreement, which was to cover employees in the manufacturing and associated industries, was submitted for pre-approval scrutiny. The Australian Manufacturing Workers Union (AMWU) had also indicated its intention for the agreement to cover its members.

The Commission was required to determine whether the application met the statutory requirements for approval under sections 186, 187, 188, and 190 of the Fair Work Act. The main legal issues involved ensuring the agreement complied with the Act, including whether it met the necessary disclosure and procedural requirements. Additionally, the Commission needed to verify that the AMWU's notice under section 183 of the Act had been properly received and that the agreement would appropriately cover the union's members.

Commissioner Mirabella found that the application satisfied the necessary pre-approval requirements and that the information provided by the Employer addressed all concerns. The Commissioner was satisfied that the agreement met all relevant legislative provisions and would appropriately cover the union's members. Consequently, the Freighter Group Enterprise Agreement - Hallam 2025 was approved. The agreement will come into effect on 17 October 2025, with a nominal expiry date of 30 September 2029.
