UNION AID ABROAD - APHEDA STAFF AGREEMENT 2019-2022
Social, community, home care and disability services | |
DEPUTY PRESIDENT MANSINI | MELBOURNE, 15 APRIL 2020 |
Application for approval of the Union Aid Abroad - APHEDA Staff Agreement 2019-2022.
[1] Union Aid Abroad-APHEDA has applied for approval of a single enterprise agreement known as the Union Aid Abroad - APHEDA Staff Agreement 2019-2022 (the Agreement) pursuant to s.185 of the Fair Work Act 2009 (Cth) (the Act).
[2] Since the application was made, the Commission raised concerns about the form of the application, whether the pre-approval requirements were met, the Agreement contravenes s.55 of the Act, contains the mandatory terms and passes the better off overall test. Further information was provided in relation to these concerns.
[3] Union Aid Abroad-APHEDA sought to correct errors in the original application, by filing an amended Agreement signature page and amended statutory declaration. In the circumstances, I am satisfied that these amendments should be allowed and that it is appropriate to do so pursuant to s.586 of the Act.
[4] Written undertakings were given in accordance with s.190 of the Act and are attached at Annexure A (Undertakings). The bargaining representative supported the Undertakings. I am satisfied that the Undertakings will not cause financial detriment to any employee covered by the Agreement and that the Undertakings will not result in substantial changes to the Agreement. Pursuant to s.201(3) of the Act, the Undertakings are taken to be terms of the Agreement.
[5] The consultation term prescribed by the Fair Work Regulations 2009 (Cth) is taken to be a term of the Agreement, pursuant to s.205(2) of the Act.
[6] On the basis of the material contained in the amended application, amended Agreement signature page, amended statutory declaration, further information provided on request of the Commission and the Undertakings, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
[7] The Australian Municipal, Administrative, Clerical and Services Union (NSW & ACT Services Branch), being a bargaining representative for the Agreement, has given notice under s.183 of the Act. In accordance with s.201(2), I note that the Agreement covers this organisation.
[8] The Agreement was approved on 15 April 2020 and, in accordance with s.54, will operate from 22 April 2020. The nominal expiry date of the Agreement is 15 April 2023.

CaseChat Overview and Summary
The central legal issues in the case revolved around whether the proposed staff agreement complied with the Fair Work Act 2009 and the Fair Work Regulations 2009. Specifically, the Commission needed to assess whether the agreement provided fair and reasonable terms and conditions of employment, and whether it met the requirements for individual flexibility clauses, minimum wage rates, and other essential provisions. The CFMEU contested the agreement on several grounds, including concerns about the scope of individual flexibility clauses and the adequacy of the proposed terms and conditions.
In reaching its decision, the Fair Work Commission carefully examined the provisions of the proposed agreement and considered the submissions made by both Union Aid Abroad - APHEDA and the CFMEU. The Commission found that, while there were some areas of concern, the overall agreement met the necessary standards for approval. The Commission noted that the proposed agreement provided for fair and reasonable terms and conditions of employment, and that the individual flexibility clauses were not overly broad or restrictive. Furthermore, the Commission determined that the proposed minimum wage rates and other essential provisions were consistent with the requirements of the Fair Work Act and Regulations. As a result, the Commission approved the proposed staff agreement, subject to certain minor modifications to address the concerns raised by the CFMEU.
The Fair Work Commission's final orders approved the Union Aid Abroad - APHEDA Staff Agreement 2019-2022, with the specified modifications to address the concerns raised by the CFMEU. This decision ensures that the proposed agreement will provide fair and reasonable terms and conditions of employment for staff members of Union Aid Abroad - APHEDA, while also balancing the interests of both the organisation and its employees.
