Australian Golf Management Corporation Pty Ltd v Logan City Council

Australian Golf Management Corporation Pty Ltd (AGMC) sought leave to amend its claim and statement of claim against Logan City Council (the Council) to include new causes of action which had been assigned to AGMC from non-parties prior to the proceeding being commenced. The Council opposed the application, arguing that the new causes of action were not based on the same or substantially the same facts as the existing causes of action, and that allowing the amendment would be inappropriate under the relevant rules.
