CaseChat Overview and Summary
The central legal issue before the court was whether the agreement complied with the relevant provisions of the Fair Work Act 2009, including whether it was made in good faith and whether it provided for the proper protection of employees' interests. The court also needed to assess whether the agreement met the requirements of the Fair Work (Registered Organisations) Act 2009, ensuring that the agreement was made by a registered organisation that represented the employees.
The court found that the agreement was made in good faith and provided for the proper protection of employees' interests. The agreement was deemed to be fair and reasonable, considering the need for a balance between the interests of the employer and the employees. The court further concluded that the agreement met the requirements of the Fair Work (Registered Organisations) Act 2009, as it was made by a registered organisation representing the employees. As a result, the court approved the Aurizon (Western Australia) Rollingstock Maintenance Enterprise Agreement 2014.
The Fair Work Commission approved the Aurizon (Western Australia) Rollingstock Maintenance Enterprise Agreement 2014, effective from 1 March 2014, and in force until 31 December 2018. The court ordered that the agreement be registered with the Fair Work Commission and published in the Commonwealth Gazette.
