CaseChat Overview and Summary

Ausbuild Pty Ltd, trading as Ausbuild, applied for the approval of the Ausbuild Single Enterprise Agreement 2018. The Fair Work Commission was the body that heard the application, which centred on the proposed terms and conditions of employment for the company's employees. The application was contested by the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU), which raised concerns about several provisions within the agreement, including those related to wages, working hours, and redundancy entitlements.

The primary legal issues before the commission were whether the proposed agreement complied with the requirements of the Fair Work Act 2009 and whether it provided for fair and reasonable terms and conditions of employment. The CFMEU argued that certain provisions did not meet the statutory requirements for minimum entitlements, while Ausbuild contended that the agreement was fair and balanced, providing for appropriate conditions for its employees. The commission was tasked with balancing the rights and obligations of both parties and determining whether the agreement could be approved in its entirety.

In its decision, the commission found that while the majority of the agreement was in line with the Fair Work Act, certain provisions needed to be modified to ensure compliance with minimum standards. The commission made amendments to the agreement, particularly in relation to the wage rates and the calculation of penalty rates. The commission held that the modified agreement was fair and reasonable and approved it accordingly. The changes ensured that employees received adequate protection and that the agreement met the legal standards set out in the Fair Work Act.

The final orders of the commission were that the Ausbuild Single Enterprise Agreement 2018, as modified, was approved and registered with the Fair Work Commission. The agreement came into effect from the date of the decision and would govern the terms and conditions of employment for the employees of Ausbuild. Both parties were bound by the terms of the approved agreement, which now reflected a balance of interests in accordance with the requirements of the Fair Work Act.
