CaseChat Overview and Summary

Auriga Pilots Pty Ltd, trading as Auriga Pilots, applied to the Fair Work Commission for approval of the Auriga Pilots Pty Ltd Deck Hands Enterprise Agreement 2022. The applicants sought to have the agreement made pursuant to section 234 of the Fair Work Act 2009. The dispute centred on the fairness and validity of the terms and conditions set out in the proposed agreement, particularly those concerning wages, working hours, and dispute resolution mechanisms. The Fair Work Commission was tasked with determining whether the agreement met the legal requirements for approval under the Fair Work Act.

The primary legal issue before the Commission was whether the agreement provided for the fair and reasonable terms and conditions of employment for the deck hands employed by Auriga Pilots. This required an assessment of whether the agreement met the statutory requirements for approval, including whether it provided for a fair and reasonable method of determining wages, included provisions for minimum working hours, and ensured that the agreement was not contrary to the public interest. The Commission had to consider whether the agreement complied with the provisions of the Fair Work Act and whether it was consistent with the principles of procedural and substantive fairness.

In reaching its decision, the Fair Work Commission examined the content and provisions of the proposed agreement in detail. It considered the submissions from both Auriga Pilots and the relevant trade union, as well as the broader implications of the agreement for the employees and the industry. The Commission determined that the agreement met the necessary criteria for approval, finding that it provided for fair and reasonable terms and conditions of employment and did not contravene the public interest. The Commission concluded that the agreement was in the best interests of the employees and approved it under section 234 of the Fair Work Act.

The Fair Work Commission's final order was that the Auriga Pilots Pty Ltd Deck Hands Enterprise Agreement 2022 be approved as a registered agreement under the Fair Work Act. This decision was made in accordance with the legal framework provided by the Fair Work Act and was based on the Commission's assessment of the fairness and reasonableness of the agreement's terms and conditions. The approval of the agreement ensures that the deck hands employed by Auriga Pilots will be governed by the terms set out in the approved enterprise agreement.
