Augustin (Migration)

The Administrative Appeals Tribunal (the Tribunal) considered the application of Augustin for a Temporary Skill Shortage (TSS) visa (subclass 482) in the medium-term stream, for the occupation of Accountant (General). The applicant's sponsoring business had been renamed and restructured, and the Tribunal was required to determine whether the applicant met the English language requirements for the visa, despite the changes to the sponsoring entity.

The primary legal issue before the Tribunal was whether the applicant's qualifications and experience were sufficient to satisfy the requirements for the occupation of Accountant (General) under the relevant visa subclass, particularly in light of the restructuring of the sponsoring business.
