CaseChat Overview and Summary

The appeal in Atzeni v Chief Executive, Department of Natural Resources and Mines was brought against the valuation of three lots of land situated near Hodgson Vale, in the Cambooya Shire. The appellants, Lawrence B and Delcia S Atzeni, argued that the valuations conducted by the Chief Executive did not properly account for the lots' use for farming, the impact of the subdivision on the valuation, and the disadvantages related to access and services. The court had to determine whether the lots should have been valued collectively for farming purposes, whether the subdivision warranted separate valuations, and if the valuations adequately considered the lots' disadvantages.

The court found that the lots were not continuously or repetitively used for farming as required by Section 17 of the Valuation of Land Act 1944. The break in farming activity and the subsequent new farming operation meant that the lots did not meet the criteria for repetitive use, and therefore, the Chief Executive's valuation was not in error. Regarding the subdivision, the court held that the registration of the subdivision plan did not constitute a subdivision under Section 25 of the Act, and thus, the lots should have been valued collectively under Section 34. Lastly, the court concluded that the valuer did not sufficiently weigh the disadvantages in access, services, and the electricity easement when assessing the lots' values.

Consequently, the court allowed the appeals for all three lots, setting the value for Lot 1 at $31,200, Lot 2 at $58,500, and Lot 1121 at $73,125, with a 2.5% discount applied due to the lots being valued as one parcel under Section 34 of the Act. The court directed that any submissions on costs be submitted in writing by 19 July 2001.
