ATP Tour, Inc v Australian Tennis Professional Coaches Association Ltd

The Federal Court of Australia heard a dispute between ATP Tour, Inc. (ATP) and the Australian Tennis Professional Coaches Association Ltd (ATPCA). The ATP, a body that organises professional men's tennis tournaments, sought to prevent the ATPCA, an association representing tennis coaches, from using the acronym "ATP" in its name and in connection with its services. The ATP argued that the ATPCA's use of the acronym infringed its trade mark rights and constituted misleading and deceptive conduct.

The central legal issues before the Court were whether the ATPCA's use of the acronym "ATP" infringed the ATP's registered trade mark "ATP" and whether such use amounted to misleading or deceptive conduct under the *Trade Practices Act 1974* (Cth) (now the *Competition and Consumer Act 2010* (Cth)). The Court was required to consider the scope of the ATP's trade mark rights and the likelihood of confusion or deception arising from the ATPCA's activities.

Justice Ian Thompson found that while the ATP held a registered trade mark for "ATP", the ATPCA's use of the acronym was not an infringement. His Honour reasoned that the ATPCA's use of "ATP" was descriptive of its members' profession (Australian Tennis Professionals) and was not being used as a trade mark to distinguish its services from those of others. Furthermore, the Court determined that there was no likelihood of the public being misled or deceived into believing that the ATPCA was affiliated with or endorsed by the ATP, given the distinct nature of their respective activities and the clear identification of the ATPCA as a coaches' association. The ATP's application was therefore dismissed.
